Oh great right next to the school they are making us WR move to, and next to the students now at PL and children who live there. Two things I don't understand though, 1)I thought sex offenders had to live so many miles away from a school and 2) I thought that apartment complex to help it's bad reputation had a rule that they did background checks and if you had a criminal record you couldn't live there.

I read something that said that they may have to live 1000 feet from a school or further if it is part of their parole or probation plan??? Does this sound accurate?

My son goes to PL... I have a real issue knowing that this sex offender will be right next door to where he is attending school and playing on the playground for recess! WTF?

NYS MANDATES that as a condition of parole, level 3 sex offenders OR those whose victims were under 18, may NOT reside within 1,000 feet of a school! This offender is a level 2 BUT HIS VICTIM WAS UNDER 18 YEARS OLD so it applies! Also, would this be based on his physical apartment number being 1,000 feet away or the property line of the complex where the fence is that is less than 1,000 feet away from the school building itself? He was not in a NY prison. He appears to be a transplant.

So he has been busy.

Maybe they can't be near a school if they committed a crime against a child. This database has all sex offenders not just pedophiles.

It says he may not be in a place accessible to the public which is within 1000 ft of the property line of the school grounds. So he could never exit his apartment within 1000 ft of the Parkland school lot line. That means he has to stay in his apartment which is private. If he wants to leave the Affinity complex he would be in violation if he waited for a bus across the street. He would be in violation if he left the complex by car since that intersection at Fetnzer/Affinity/English is within 1000 ft of the school property line.
Unless he is housebound with agoraphobia or some physically debilitating condition like he weighs 600 lbs or can't walk, he can't live there.

The law doesn't specify where people can reside but if he ever wants to leave his apartment he can't live there.

Of course he could exit his unit and take a helicopter or rocketeer to work but that's a stretch. Or he could exit his apartment and park over at the Mormon Church to avoid proximity to the school lot. Who knows what the has planned.

And there is the possibility that he is an offender that is not on "probation" or "parole" since he never was in a NY state prison. See the law does not say the offender can't live there. Only that he would break terms of parole or probation if he was physically there. This man was never in a NY state prison and it appears he might not be in either program presently. Look him up. He is not there and never was.

NYS LAW: New York State law mandates as a condition of parole that Level 3 (high risk) sex offenders or those offenders with victims under the age of 18 may not reside within 1,000 feet of a school. The State also mandates as a condition of probation that Level 3 sex offenders and those whose victims were under 18 may not reside within 1,000 feet of a school. These are the only state laws regulating where sex offenders may live.

IT IS A CONDITION OF PAROLE he is not on parole or probation so it does not apply.

It is 5 hours since I left him a voice mail and I am yet to hear back. We did confirm today that the building this offender lives in is the one directly next to the school!!!

He is allowed to live there. You all are mis reading the law. He is no longer under supervision. He is married lives there with his wife and they have children that also live there.

What a nice man...married with children and a criminal history as recent as his June 2011 arrest in Florida for possession, as well as being a registered sex offender for RAPING a 16 year old young girl! Just what I want living next to my kids school! And does that mean his children are attending PARKLAND? So now the parents have to worry about this man at events on school property? Lovely! Yeah, we are misreading the law.....sure we are...he has so much right to be there so we will just get all warm and fuzzy and welcome him and his dear family with open, loving arms! NOT!!!

If you read the link you provide you can see that.
A. He was convicted in 1998
B. He was sentenced to 5 years probation.

Therefore he no longer carries the restrictions on where he can live since he is no longer on parole/probation.

Also he was convicted of 3rd degree rape. More commonly know as "statutory rape". The victim was 16, he was at most 26. Chances are he was but younger, given the time it would take for a case to get through the system. I am not saying I think 26 year olds should be having sex with 16 year olds, but some context is sometimes helpful.

While I think it is a good thing to be aware of the situation, I am not sure we should be up in arms or grabbing pitchforks.

To 6:56PM ~~ First of all, the notice of his move to Greece was sent out to put people on alert. There's a reason for such alerts, based on track records for these sorts of offenders.

Secondly, sex offenders have an extremely high incidence of recidivism.

Thirdly, we don't allow 26 yr. old teachers to engage in sex with teen girls or excuse them after they've done so, do we?

As I recall, the parents of LR were up in arms about a nearby resident who had been convicted of sex crimes showing up to vote at their elementary school! They got Robach to sponsor legislation to prevent that, so I think the parents of PL have the right to question this, get the details and facts. This is part of what is known as parental involvement, something that we're told is a positive thing ;)

To 6:52PM ~~ Are you suggesting that GCSD provided details about his homelife that weren't provided in that alert? How did you receive that kind of info? On paper? By phone? In a conversation?

Three men were arrested at the same time as he was with the same conviction of rape. They have a criminal judgement against them from 1998-1999. Without naming the other 2 names, it might not be a romance between a 26 year old and two other men who were even older than he was and a 16 year old boy or girl. Three on one? Sounds like more than an oooops.
But if he is off probation he can live where he wants.

12:28. The voice mail is for LT Roff or Rofe not Rossi. But thanks. I'm guessing there is no violation here. He was not after young children. No need to panic just be aware. Unfortunately lots of sex offenders live in our town and surrounding towns.

At this time, there is nothing that can be done but to keep a close eye. The officer informed me that rochester city police department dropped the ball and never contacted him either. Nice, huh? He was making the proper calls from there.

He looks like a niceyoung man and he has a wife and children who will probably be coming to a GCSD building for reduced price lunches and education. This fellow could well be an asset to the PTA, and I'm sure he will be more than happy to enlighten young boys & girls about the terror of making just one little dating etiquette error.

Lts not turn this into another Bryant & Stratton issue. Who knows this young man might even be a B&S student.
