FINALLY, COMMON SENSE PREVAILS!!

Brighton Town Justice John Falk quoted from New York Penal Law Section § 35.15 regarding Justification; use of physical force in defense of a person. 1. A person may...use physical force upon another person when and to the extent he or she reasonably believes such to be necessary to defend himself, herself or a third person from what he or she reasonably believes to be the use or imminent use of unlawful physical force by such other person.

STORY

SCATS ~~ This had to be the MOST inane court case I've heard of in the years I've run this BLOG. Thank God the Brighton judge used his head. Justice prevailed because this silly incident didn't happen in Greece.

Just think what the Green Giant will be able to do as a Federal Judge with a life appointment!

Just heard that there is now a civil case against the father. One more trial, and this time is only required 5 out of 6 jurors to find for the plaintiff. A lesson for our children - doing the "right thing" can be costly, and we don't always get to chose our consequences. The lesson is to do the right things anyway.

To 7:17AM ~~ Let's try not to lose sight of the fact that in that lesson, our children should be learning that picking a fight is unsportsmanlike behavior! Had that lesson been imparted earlier, there would be no case at all ;)
