CASE AGAINST BRIAN BALL DISMISSED


DEAL STRUCK WITH TOWN OF GREECE

Will be permitted to retire or resign,
possibly with back pay

WHEC-TV reports: "DA's office tells I-Team 10 it's is no longer in a position to go forward with the appeal at this time, instead waiting for the outcome of an administrative proceeding between ball and the town of Greece."

Court Decision

SCATS ~~ NOTHING to see here, folks. Move along now. Every stone has been turned over.  Nevermind how much it will cost you in taxes to finish this corrupt game played between Uncle Auggie and the DA to save the former's backside ;)

It would seem that Mr. Ball is fortunate that the district attorneys are procrastinators or they stalled on purpose. They appealed the Judge's dismissal of the case against him serving it 60 days after the judge's decision to dismiss the original charges November 2, 2009. The first action by the county is January 8, 2010 which is clearly not within 30 days. Another filing is April 2, 2010.

This is from NY state law NY CPL Section 460.10, subsection 1.c)

"If the people are the appellant, they must, within such thirty
day period, serve a copy of such notice of appeal upon the defendant or upon the attorney who last appeared for him in the court in which the order being appealed was entered."

The appeal of the county was denied because of timeliness. Ouch. Don't they know the rules? Or did they goof on purpose not wanting to prolong the agony of their ineptitude and lack of a case?

He gets the choice to resign. Then he could sue for defamation of character and slander unless there is a really good deal in the back rooms. The Police Department and town and the DA's office did destroy his reputation and the state has upheld that their case had "no substance". Can he also sue for false arrest?

To 10:39AM ~~ I wonder if anyone is keeping a tally on the pricetag settling all of these lawsuits is going to have on Greece taxpayers. This kind of stuff will continue for quite sometime into the future, I'm afraid.

I bet you are keeping tally SCATS and good for us that you do. It is good someone keeps their eyes and ears open and shares it.
Brian is a heck of a ball buster and it sucks what happened.

SCATS, you're implying that they shouldn't have gone after Brian? Everybody (especially the officers) knows that Ball was in Rahn's hip pocket and helped do his dirty work. No one in GPD wants this guy around. Despite the people at town hall you don't like, you need to know that Meritt Rahn and Brian Ball were very bad men. They don't deserve to be defended by anyone.

To 7:42AM ~~ I don't think I was implying ANY SUCH THING! Please read my comments on the BLOG. Ball was another snake-in-the-grass, IMHO. He wasn't the biggest serpent though. Auggie gets that title.
