AUBERGER TAKES STAND !

READ Memo Rahn wrote to Auggie about his missing gun

"In June of 2000, Skip Beaver and I obtained a new service weapon for me from the armory."

Auberger gave Rahn a "verbal reprimand" and "told him to be more careful."

WHEC-TV Reports Auberger to testify at 2PM TODAY

Greece Supervisor John Auberger is expected to testify Wednesday at the trial of former Greece police chief Merritt Rahn.

I suggest you follow Berkely Brean on Twitter, since the D&C's Greece reporter notified me that they do NOT plan to LiveBLOG his testimony.

Don;t get your hopes to high. His testimony could be restricted at this point to some events around the gun. That might limit the scope of cross examination.

Unless Parinello has him as his own witness on direct and he can ask him anything. But he has to be careful on what he brings up in case then on cross the DAs can follow up. He would be then considered a hostile witness of the defense. Just like Matlock. Omigod Parrinello is Matlock so he will have to win.

What everyone is overlooking is that NOTHING restricts JP. He brings up whatever he likes so the jury gets to hear it even if they are instructed to disregard by the judge. By then the damage is done. It's done routinely in such cases.

To 12:55PM ~~ I agree. Like it or not, THAT is how a good defense atty operates under such circumstances. He's doing his job, much to the consternation of many in the audience.

12;55 What I was bringing up is that JP does not want to open the door on some issues that are not part of this case but if HE brings them up they are fair game for the prosecution. They then could ask more questions about the prior bad acts that were not allowed in. So he is restricted in what he asks for the good of his client.

To 2:06PM ~~ That's a good point! BB is describing Auberger's testimony as VERY CAUTIOUS ~~
"He's pausing with every question and only answers, "Yes, sir." "No, sir."

Auberger is using the "I don't remember" response like Hillary did so many years ago. Can't the DA or JP subpoena the emails and memo's and day planners from those dates? A public official should be more accountable than that.

What is so upsetting in all this is the human toll that was taken because of the lack of oversight of the supervisor of Greece. He is saying on the stand that he didn't care about the gun or the report. He also didn't care about who was hired that hurt women that have come forward. Many lives have been impacted because of the apathy and laziness of our "leaders". The woman on the expressway that was crashed into by a cop that was known to be a drug abuser. Women that had sex coerced by a police officer that was recommended by JP and hired by Rahn and Auberger. How can we as a town feel good about that. Auberger should resign. He may not be guilty of a crime in the penal code but all this was under his watch. He should be ashamed.

To 4:20PM ~~ They probably got shredded last year when Auggie had the Clean Up Greece Day and the document shredders were outside of Town Hall. Wasn't that right around the time Rahn, Ball & Mackin got caught shredding at PD?

Don't look now but Auberger's bringing back the industrial document shredder again this year. Maybe he needs to clean up after Joe Loszynski finishes up.

Skip Beaver. Isn't that name familiar?

To 12:56PM ~~ It should be. Last time he was in the news was after the Greece Chamber made him their Prez. Sadly, before the ink had dried, he was arrested with another man in a park for engaging in indecent acts. I sent the headlines about him into Leno's show ;)

To 2:17PM ~~ Thank you! If you search "Beaver" on this BLOG, you'll find the various times he was in the news about the "lewd acts." Sadly, even the Greece Post has made the story unavailable on their website. Thank goodness someone posted straight from the D&C so we can refresh our memories about the WHOLE TRUTH.
