Greece PD: Took NO Pictures of Cervini's Body

 
UPDATE 12/4 ~~ According to WHEC-TV: "Today, an ambulance technician took the stand, saying that there were no bullet wounds to Cervini's back."
And according to today's D&C : "Parrinello questioned why the body was moved before its exact location was marked in the roadway." The EMT's moved Cervini's body before GPD collected any evidence! I know NOT to do this from watching TV dramas! Maybe GPD needs some instruction, remedial crime scene processing perhaps??

This case shouldn't even be tried. It's all meant as a diversion. Hopefully Scott goes free.

No pictures? Wasn't Brian Ball in charge of evidence collection? Just another good reason why he's gone.

So the comedy of errors continues? Am I correct in thinking that the officer who testified that he couldn't recall seeing blood at the scene is still employed by Greece police? If he is what does this tell us? It tells me we've stopped cleaning house much too early! And who is responsible for not taking pictures? This person should be FIRED pronto!

To Graehaven ~~ I hope he's found NOT GUILTY ... acquittal is second best. As I understand it, the ONLY issue here is whether Scott's claim of self-defense holds up when examined by reasonable people (jurors). The lousy job done by Greece Police at the scene is causing me to think they railroaded this poor man (Scott).

To Scats -- Yes, by all means, not guilty, if acquittal is second best. Didn't think about the difference there.

To protect and serve - some of them are doing neither. I hope the house cleaning continues.

Sorry but I do not want kids killed for breaking into cars and to me that is what was going on!

I think he is guilty of reckless endangerment.

To 10:37AM ~~ Neither of the things you mention are issues at this trial. And I really don't see him getting convicted of manslaughter either. All he has to prove is that the average person would have reacted as he did when Cervini came charging at him. That's really all there is to it.

SCATS - with all due respect - how do we KNOW that Cervini came "charging at him"?? Because he says he did? You are assuming something that has yet to be determined as "truth" as the basis for your opinion on how this should resolve.

Not saying where I stand either way on this -- but let's not assume that Mr. Scott has NO liability in this based on his testimony alone.

To 3:40PM ~~ I try to assume nothing. If my recall is correct, one of the witness statements made to police (possibly by one of the two other boys involved?) corroborated that Cervini was heard yelling something about "i'm going to get you" while running down the driveway towards Scott.

What was Scott supposed to do at that point? Run in fear. It's 3 o'clock in the freakin' morning man! It's dark, he's got THREE menacing individuals facing him - that he stumbles on and confronts. Should he run screaming back into his house? No. He stood his ground and did his duty as a citizen, father, and property owner.

It's too bad about the kid - who was playing the role of adult criminal - and he got burned. It's all very sad. Welcome to life - it's not fair. I'll bet you that the other two NEVER do anything this stupid again.

Stop molly-coddling stupid youth who should be held responsible for their actions. If the other two weren't minors, I'd expect the Cervini family to bring civil suit against the other two for negligence. That's where the culpability lies. Cervini is NOT the victim here.

To 10:25AM ~~ Just an FYI ... one of the other two kids was Cervini's own cousin, who was serving his SECOND PROBATION (we call that a REPEAT OFFENDER) the night this event happened.
