SHARP FAMILY SUING GPD IN JOSEPH CRASH CASE


13WHAM News Reports ~~ Azaria Green's Family Files Suit Against GPD, Several Named Officers & Town of Greece Over Nick Joseph Crash Case

Named officers include: Rahn, Mackin, Ball, Wise, Trowbridge, Elmore, White, Schamerhorn, Pignato & Joseph

Claims Joseph's background records of incidents requiring disciplimary action were shredded and evidence in the crash was destroyed by shredding to protect him

EVERY officer who knew Joseph left the seen and was taken home can no longer stay on as they can no longer be trusted. EVERY ONE

See paragraph 82 of the document. it says that a notice of claim was served on Nicholas Joseph in September 3 , 2008.
Does that mean that originally she was suing only him and the everyone suit came after the whole messiness of Greece Police was public?
This is big and they have excellent lawyers.

To 6:19PM ~~ I'm not 100% certain, but I do recall something was filed last Fall about the intent of this family to sue for the ongoing health issues sustained by the baby.

As a taxpayer, I will pay whatever award the jury and the court assigns. We are all the victims in this mess, but this child was not even out of the womb, and was scarred for life.

Shame on us all.

Hey scats. Not to plie on the scandal but the D and C is reporting a very high up republican has been indicted in the ROBUTRAD scandal

The head of the county republican party was arrested for that mess and pleaded not guilty and was released ror. It was on the news at 7 on 10.
he is on the town board of some east town maybe penfield.

Well, you had to know that lawsuit was coming...and it's justified, too. I agree that the one person that was most affected was the baby. I hope the court awards generously and that the other family members who will be caretakers are compensated for their pain and mental anguish and their lifelong commitment of care to their child.

It's reprehensible how this kind of travesty could ever be covered up by our town "officials".

What I do nto understand is this child has severe health needs and the gradmother is the guardian and, yet the mother and father are having another baby, or just did. And no matter the baby is the only innocent, if in fact Ms. Sharp did not have a licence at the time.

To 9:35AM ~~ I do not believe her lack of a valid license at the time in any way impacts this case because her vehicle was stopped due to mechanical troubles when it was hit. If your engine isn't running and the car isn't in gear and moving, then technically speaking you are NOT "driving."

Scats I see your point, yet if you don't have a lic. you should not be on the road period. It may be a technicality.

To 9:55AM ~~ I agree she shouldn't have been driving if that was the case. I believe it is a technicality that she can't be charged, just as they probably can't charge someone for failure to wear a seatbelt if the car isn't moving, too ;) If she tries to sue in her own name, perhaps that point will become an issue.

One more point ~~ No matter what the situation was with her license, NICK JOSEPH WAS IN THE WRONG. HE WAS WRECKLESS. HE WAS NEGLIGENT. HE WAS COKED UP, DRUNK AND SPEEDING. HE WAS COMPLETELY OUT OF CONTROL. HE WAS THE POSTER BOY FOR EVERYTHING A COP SHOULD NOT BE.

And I thank God we found out about him, because it brought to light all our other ills in Town govt.

This is a civil rights case....14th amendment. This is indeed a federal case.
And it is terrible what happened to that family but it brought to light all the corruption in the Greece police. They would still be harassing women and faking reports if not for this.
What lawyers will defend these individuals that are named in the suit? Since they are fired from greece or suspended or arrested do we have to pay for their lawyers?
