Parinello: Greece Town Board Acted Unlawfully

RNews reports:

The lawyer representing suspended Police Chief Merritt Rahn said the actions taken by the town board against his client were illegal.
John Parrinello said the board acted unlawfully when voting to charge Rahn with wrongdoing because the meeting it held was not properly advertised.

Parrinello also claims town board members were ordered by Greece Town Supervisor John Auberger to vote for the charges and the vote was not a free exercise of each member's voting authority.
Rahn was suspended without pay after an internal investigation lead by retired State Police Investigator Joseph Loszynski found more than 40 allegations of wrongdoing against Rahn. Greece Director of Constituent Services, Kathryn Firkins, would not comment except to say, "We are confident of the appropriateness of the process.”

So they had an executive session which should be part of an open meeting that has to be properly posted. That is of course not possible if it is an emergency meeting called by one of the board members. Then it is posted "to the extent practicable" to the public.
Sometimes that means that there is no posting 3 days ahead but the law allows for these emergencies. The lawyer is scratching the bottom of the barrel for this. Nice try though. He must have nothing else as defense.
And the lack of notice for a meeting does not change the charges. It does not take away the charges as if it was evidence that can not be admitted. In fact the town is not bringing penal code charges against him. They are departmental and disciplinary. It would be the DA and the state police that would bring charges of obstruction of justice from the shredding of the evidence in another case. And he isn't complaining about that bag of confetti. This is a diversionary tactic and will help him with billable hours.

I think everyone, judges, prosecutors, the public and the press are weary of Parinello's theatrics. "Will help with billable hours" is spot on.

The nonsense has gone on to long.
From what is written as chargeable offenses against the Chief should have and could have been addressed if the town supervisor had a proper employee evalution process in place and administered it as the town's Chief Executive.
The concerns over the chief not administering the department policies and proceedures correctly have been the peoples concerns before Joseph and Pagnato were hired.
Because of political pleasures the town supervisor failed in his duties to administer the evaluation process and follow civil service protocal.
The buck does not stop with the Chief violating policy, it goes right to the supervisor for not doing what he was elected and paid a considerable amount of tax payer money to do. Administer the Town.
John Auberger needs to leave as supervisor.

I think we should rename the Greece Town Board Johnnie's 5 zip and out.
This indicates how all of the town board votes have gone since Johnnie was elected.

1:28 am - really? I'll admit that none of my neighbors brings any of this up when we're together. We talk about our jobs, kids, summer plans, etc. Do you honetly believe these issues define our town? I thought it was all the great things that brought us here in the first place. That's really sad if you truly feel that way. People I know here like this community. Many have the means to move if they were as weary as you claim they are. I never understand why people stay somewhere that they trash constantly. Are people that bored or is it that they don't have anything else in their lives? So much negativity does nothing but divide and destroy. I hope that's not the intent here.

6:36 You're wrong. It's the scandals and politics that divide and destroy. Without those two ingredients we'd be living in Neverland.

Did it ever occur to you that since you and your neighbors don't discuss this stuff and get involved or take it seriously that YOU ARE PERPETUATING the trouble?

Greece needs some of Obama's change.

You are right we don't like the scandals and lack of ethics but for 2 reasons we stay. First it might not be any better in any of the other towns. And unless we left Monroe County we couldn't escape the dysfunction.
Secondly have you checked the real market value of your property. No one can move without selling a house that will sit on the market until we lower the price to market value which is less than it was 3 years ago.
So we sit and watch and wait. And yes we will complain. If you don't want to listen to us click on another web site.

Town meetings are now being shown on Ch 15. The new camear system(joke) is in use, and the image is very defocused so you can't see who is talking. The focus seems to be set about 15 feet in front of the camera. Audio quality is better than Educable provided so the entertainment value is still there.
The camera angle does a wonderful job of showing all the empty chairs where an audience might sit.

To 6:50AM ~~ I wonder how Obama's tax cheats compare to Auberger's Town Board double-dippers who hold or held two jobs ~~ one in Greece & one in a county position. Of course, none of them are suspected of any wrong doing ... or Robu-trad involvement ;)

11:19 - go ahead and complain all you want. no one's stopping you. but trashing your own community serves no purpose. it's poor political campaign strategy. complaining and taking action is one thing. dumping on the community is another ball of wax.

Also, your comment on the fluctuation of home market values in nothing new. That happens all the time, hence periods where it's a seller's market and buyer's market.

SCATS - insulting voters doesn't help either and won't get you the results you seek. ;)

Time warner has not taken over channel 15 or 12. When contacted TW apparently said they had no current plans or agreement to run these channels. That was supposedly reported by someone who asked. My information is indirect but t seems true. Exactly what meeting is poster at 11:31 referring to?
